Show TUTTLE BROTHERS SUED Bf mm h, burts Plaintiff Says He Got the Worst of a Real Estate Deal. Walter G. Tuttle, Sereuo B. Tuttlo and Marcellus S. Woolcy, doing business busi-ness under the namo of Tuttlo Brothers, aro made defendants in a suit filed iu the Third District court Saturday by-Joseph by-Joseph and JIattio Roberts in which the plaintiffs seek to recover $2,952.35. Tho plaintiffs allege that tho' purchased pur-chased a piece of property in Salt Lake City from the defendants, who represented repre-sented themselves to bo the authorized agents of Isabel L. Denny, of Beaver, who was the owner. Thoy allege that an agreement was entered into whereby where-by they agreed to pa' $300 down on the property aud tho balance in monthly month-ly payments of $20 each. They allege that they paid the $300 and made tho monthly payments regularly until $640 in all had been paid on the nropertv which tho defendants agreed to sell them for $2,050. It is further alleged by tho plaintiffs that improvements wero made on tho property which were of a value of $250 and that after this was done Isabel L. Denny demanded possession of tho premises pre-mises and an action, for ejectment was commenced iu the Third District court; that the case was tried and on tho ground that there was a question as to tho authority of theso defendants to act for tho owner of the property a judgment for ejectment was entered and also judgment for damages and costs amounting to $424.00. Tho plaintiffs further set forth that fhey afterward made a tender to theso defendants of tho balance of tho purchase pur-chase price of the property. Thoy also allege that the property has increased in value and is now reasonably worth $4000. It also is set forth that they havo been deprived of $040 aud the use thereof that they have expended $250 in improving the property; that they have incurred costs and" expenses in defending tho former suit amounting to $176.S0: that tli03r havo become liable on the judgment for the sum of $434.90; that they, havo expended. $35 in interest on borrowed money; that tliC3' havo lost tho benefits of their contract of sale in the sum of $1350. |
