Show DIVORCE SUIT DISMISSED IN DISTRICT COURT The divorce suit brought by Eliza A. Ovard against John Ovard was dismissed dis-missed by District Judgo Hall yestor-day yestor-day without prejudice to either party. Tho defendant was charged in tho complaint com-plaint of the plaintiff with habitual drunkenneso and cruelty, the wlfo averring aver-ring that her husband had thrown her down upon tho bed, choked her and otherwise maltreated her. In his answer the defendant denied the charges, dnd in turn accused his wife of leaving home to go with othor men to the Salt Palace and to Caldor's park. The charges on both sides wero of a sensational sensa-tional nature, and now the whole case is dropped. Court Notes. William R. Waples was yosterday appointed ap-pointed receiver In the case of John R. Norrls, an Involuntary bankrupt. Suit was filed In tho District court yesterday by W. C. Tracy against the Wheeler and Wilson Mining company, to secure Judgment for $900, alleged to be due for services rendered as manager man-ager of the defendant company. In tho condemnation BUlt of the Oregon Ore-gon Short Lino Railroad company against Aaron Keysor ot al., which was tried before District Judgo Stewart, tho Jury yesterday returned a verdict In favor of the defendants for $76S7.50. In a complaint filed in the District court yesterday, W. H. Parker Is suing G. R. Walker for 51500 and Interest for a collection of birds' eggs. The plaintiff plain-tiff alleges that In April, 1902, ho delivered deliv-ered to the defendant, at his request, a collection of birds' eggs in a cabinet, for which ho agreed to pay $1500. Tho agreement, It Is alleged, provided that the above sum should be paid in monthly month-ly installments of 5100. The plaintiff charges that no part of tho amount has been paid, although often demanded. Mary E. Kelly brought an action in the Third District court yesterday against Elizabeth and O. R. Meredith, to securo a restraining order preventing tho defendants from moving the fence on the east boundary ot the plaintiff's property. Edward Joseph Mullen, one of the convicts who participated in the Jail break at the penitentiary last October, was arraigned in tho District court yesterday yes-terday and given until Saturday, March , 26th, to enter his pica to the information informa-tion charging him with escaping from tho State prison. Thero was only ono case In the City court yesterday morning, in which the John ParsonB company of Omaha, Neb., petitioned to havo their suit against vTohn Bayea, at present residing In this city, transferred to the civil courts here. Tho suit was for a bill owing them J95.70 in February, 1S98, In Omaha. On Monday there will bo a genoral setting of caacB by Judgo Marshall In tho United States Circuit and District courts. All suits that will come before tho court during the April term will bo sot for trial at this time. |
