I NEW TRIAL DENIED Thomas Irnlay Must Servo His Sentence Sen-tence for Criminal Assault Tn an opinion written by Chief Jus Lice Barlch and concuried In by Justices Jus-tices Miner and Baskin the Supreme court yesterday denied a new trial to Thomas Imluy convicted of assault with intent to commit rape Imlay was found guilty of coalmining the assault as-sault upon Kate Judd a girl 15 years of age and sentenced to eighteen months Imprisonment in the State prison Almost immediately after the crime was committed the glrli made complaints to Taylor Norton Sarah Lewis and Hannah Judd Th < v testimony testi-mony of these parties regarding the complaint of the girl to them was admitted ad-mitted In evidence by the trial court This the appellants counsel contended was error and on that contention the appeal was based The Supreme court ruled that the complaints having been made almost Immediately after the crime was committed the complaints were part of the yes geslae and the evidence was properly admitted
