Show ANOTHER OPINION This Time it Was About Preference Rights Replying to several questions propounded pro-pounded him by the state board of land commissIoner the attorneygeneral I yesterday delivered an opinion In the matter of amending an application after the time to file the same has expired ex-pired The law says the official under which the applications are made aplcatlons requires re-quires certain qualifications a to citizenship citi-zenship time and tme the nature of the occupation oc-cupation of the land for which the applicant ap-plicant claims the right of preference I also requires the application of the preferred claimant must b mad before the first day of next month but does not specify the form or in other words what the application should contain The attorneygeneral says the applicant should follow as nearly as possible the form drafted by the board and the questions set out should be answered but the mere fact that there answere fai ure to answer some or inadvertence Instating In-stating all the facts would not deprive him of his rights The attorneKen eral says the filing o an application for a preferred claim would entitle the applicant t a preference right if he could satisfy the board that ho rrympi within the law Inasmuch as the < board has the right to decide contests and determine de-termine qualifications the attorney I general advises there Is a certain amount of discretionary matter rest ing with it |
