Show IMPUDENCE OF THE CITY COUNCIL f Friday morning The Herald said at tht Close of an rticle on The Mayor and the Council wIt w-It can bo said without fear of suc cpssful contradiction that in the matter mat-ter of nominations the council has lean far more considerate of the mayors wishes than the mayor has of the councils The Deseret News after quoting this says Passing by the glaring misstatement misstate-ment contained in this sentence the reader will be struck with the mpu terce of the broad intimation conveyed con-veyed by it that the mayor is i expected tu conform to the wishes of the council coun-cil in making his selections of men who are to be associated with him as heads I of city departments and other positions under the municipality and for whose admlnlstratSh ilal public itehO he viII IM 1 > held responsible His own wishes and judgment in the selection of his subordinates and associates and his own legal rights in the premises do not count as against the plan of campaign determined upon by the caucus and its outside manipulators There was no glaring or other misstatement mis-statement in what The Herald said The mayor has desired that certain gentlemen flU certain offices and has sent their names into the council fr confirmation They have all beer confirmed con-firmed in accordance with themayors wishes except in two instPjices in one of themthat for chie of police the council after r ferri lg the nomination I back for his honors reconsideration rejected I re-jected it when his honor sent it in a second time In the other casethat of the nomination for chief of the fire department de-partment the council has taken no action ac-tion Do not the facts show that the crunch has been more considerate of j thema ors wishes than the mayor has been of the councils I The News says that in its quotation from The Herald the reader will be I struck with the impudence of the broad intimation conveyed by it that the rtayor is expected to conform to the wishes o the council in making his I I selections of men who are to be associated asso-ciated with him as heads of departments depart-ments and other positions under the municipality and for whose administration adminis-tration of public matters he will beheld be-held responsible If it Is impudence in the council to think that the mayor I should have some regard for Its wishes in the matter of making his selections for office they have legal warrant for I their impudence for the state law says that the mayor by and with the I advice and consent of the council may appoint all such officers and agents as I may be provided for by law or ordinance ordi-nance and in like manner fill all Vacancies va-cancies among the same except as otherwise provided by law It may II be that it was impudence on the I part of the legislature to confer this power of confirmation on city councils If the law contemplates that the heads of departments shall be agreeable to and in harmonv with the mayor It no less contemplates that they shall be I agreeable to and in harmony with the council as well for the council is given the power to confirm or reject as it shall deem wise The News talks very haughtily about the mayors own wishes and judgment In the selection of his subordinates sub-ordinates and associates and hs own legal rights in the premises Is all the deference to be paid to the mayors wishes and none to the councils coun-cils So far as his own legal rights are concerned they are not one whit greater than the councils own legal rights they are derived from precise pre-cise the same source The Xews says it would have been quite willing to see the mayor go even more than half way in compromising differences with the council for the purpose of securing such results but in the light of recent developments we are inspired with the hope that he will stand firm There is no objection in the world to the mayor standing firm but when it comes to firmness there Is no doubt the council will stand just as firm as the mayor He was elected mayor and not autocrat but he and I his supporters appear to think he was elected autocrat And we close this article with the same sentence with which our article of Friday closed It can be said without fear of successful suc-cessful contradiction that in the matter mat-ter of nominations the council has been far more considerate of the mayors iFhes than the mayor has of the councils coun-cils |
