Show l'.'33l GI FcPiilnnton City By ROSELYN KIRK FARMINGTON - Davis County Planning Commission has received a request from Farmington to place a moratorium mora-torium on any development in the county area west of the city limits, specifically west of 1-15 until the Farmington master plan is complete. The Davis County Planning Commission received a letter to that effect but no decision has been reached by that body, according to county planner Joseph Moore. THE commission discussed the legalities of the moratorium mora-torium based on an opinion . obtained by the county planning plan-ning office from County Attorney At-torney Milton J. Hess. According Ac-cording to Mr. Hess, state statutes allow the city and the county to cooperate to plan the area. In the event that both the citv and county have adopted master plans, agreeing on zoning in a city area that could become a part of the city, the county would have a "reasonably sound basis for not approving any kind of zone change or development in that area inconsistent with the adjoining! city's master plan," Mr. Hess said. ACCORDING to county planner Scott Carter, who is also on contract through the county to act as a Farmington city planner the opinion seems to allow the city latitude lati-tude to go out into the unincorporated unin-corporated area and plan. The desired result of the letter is to bring the city planning plan-ning commission and the county planning commission together in a session so they can agree on a plan for the area. Mr. Carter said the groups may meet together for this purpose early next month. . ACCORDING to Mr. Moore, the ability of the county to enact a moratorium in the area is not clear. It was Mr. Hess' opinion that in most I i cases a moratorium is declared in connection with the enactment of new zoning ordinances. This is not the case with the area in question. ques-tion. According to Mr. Carter, it is the hope of Farmington that the county will declare the moratorium to gain time for the city to develop the master plan, not scheduled for completion until mid 197S. PLANNING for the area west of 1-15 is addressed in the Farmington master plan, the letter says. "We are fearful fear-ful that any development oc-curing oc-curing prior to the completion of the same would be detrimental de-trimental to the orderly growth of our city." The letter continues by asking that any residential subdivision development in the area be placed under moratorium Mr. Carter said, not only is Farmington requesting a planning session with the county, but is also working with neighboring cities Centerville, Kaysville and Fruit Heights to determine natural boundaries between tht cities and cooperate in planning. |
