Show 90-Day Study Ordered Prior to Sentencing Seventh Judicial District Dis-trict Court Judge Edward Sheya presided at the regular re-gular law and motion day here in Moab Tuesday. A heavy docket was heard. Wilford Heath and his counsel appeared before the court for sentencing. The defendant had been previously convicted by a jury of theft of a calf belonging to Silliman-Connor, Silliman-Connor, Inc. The defendant defen-dant and counsel for the state had requested a presentence report from the Adult Parole and Probation Pro-bation Hoard. The report and Judge Sheya had duly considered the sentence. The Probation department depart-ment recommended that the defendant be committed com-mitted to the custody of the Division of Corrections Correc-tions for a period not exceeding 90 days as provided pro-vided by I'tah Law during which the said Division of Corrections shall conduct con-duct a complete study of the defendant, inquiring inquir-ing into such matters as his capabilities, his social soc-ial background, and his mental and emotional health, and that thereafter there-after upon completion of this study, the defendant be returned to the Court for sentencing. Both the County Attorney and Defense De-fense Counsel told the Court thai they were fearful that the defendant hadnental problems and that such a study concerning concer-ning his mental health would be very helpful before be-fore sentencing the defendant. de-fendant. The Court adopted the recommendation of the Adult Parole and Probation Proba-tion Hoard and the County Coun-ty and Defense attorneys and admitted the defendant defen-dant to the Division of Correction for said study, the defendant to be sentenced immediately immediat-ely thereafter. In State versus Samuel Sam-uel K. How land, the defendant de-fendant was present with his counsel for arraignment arraign-ment on two charges of theft. The defenda nt pleaded guilty to both counts of theft set forth in the Information. A presentence pre-sentence report was recommended re-commended by the County Coun-ty Attorney and defense counsel and the court ordered or-dered the same and the date set for sentencing was Nov. 13, at 10 a.m. In other matters considered, con-sidered, Preston L. Nie-son Nie-son was granted a divorce from Terry LynnN'iesen, Vonda Rae Shumway was granted a judgement against ag-ainst Arthur Hay Shumway Shum-way for the sum of $725 for arrearages in al- limony and support payments pay-ments and attorney fees. Colleen M. Stewart won an interlocutory decree of divorce from Clive Leo Stewart. Sue Moore was granted a divorce from Ray Moore and Eth-lene Eth-lene Steele was granted a decree of separate maintenance from Eugene Eu-gene Steele. The Judge rounded out the calendar by granting grant-ing numerous petitions fur distribution in probate pro-bate and approved numerous num-erous final accounts and granted two adoptions. |
