NOTICE OF INTENTION PUBLIC NOTICE IS HEREBY GIVEN that on the 21st day of December, 1978, the Mayor and City Council of Farmington City, Davis County, Utah, adopted a resolution declaring its intention inten-tion to create a special improvement district to be known as Farmington City, Utah Special Improvement District No. 79-1. It is the intention in-tention of the City Council to make improvements within said Special Improvement District and to levy special taxes as provided in Chapter 16. Title 10, Utah Code Annotated, Anno-tated, (1953), as amended, on the real estate lying within said Districi for the benefit of which such taxes are to be expended in the making of such improvements. DESCRIPTION OF DISTRICT The boundaries of the proposed Special Improvement District shall coincide with the Farmington City limits as of the date of this notice. INTENDED IMPROVEMENTS The improvements to be constructed within said Special Improvement District No. 79-1 in general include the replacement andor excavation excava-tion for and construction of 30" high back curb and gutter together with diversion boxes, catch basins, culverts and other structures to control surface water along the improved streets within said proposed District, the excavation ex-cavation for and construction of sidewalk, the excavation, grading, graveling and paving pav-ing of hot compacted plant asphalt, and the construction of drive approaches (optional); (op-tional); and all other miscellaneous mis-cellaneous work necessary to complete the work in a proper workmanlike manner. Without limiting the above general description of improvements it is intended that the improvements be constructed in the designated areas as follows: A. 30" High Back Curb and Gutter Replacement and Miscellaneous, Mis-cellaneous, with State of Utah Participation ;;',rH) t 1. State Street between Main Street and 100 East Street, both sides of street, and State Street between Main Street and 100 West Street, south side only. 3. Second West (200 W.) Street, south from State Street 530 feet (from corner of property lot) on west side and 495 feet (from corner of property lot) on east side. Highway 106 from 200 South Street and 200 East Street northwesterly 1127 feet (from corner of property lot), west side only. H. Drive Approaches Property owners on all above mentioned streets may elect to have drive approaches replaced and or constructed on their property. Miscellaneous includes the replacement andor construction con-struction of sidewalk and curb and gutter necessary to complete the improvements in a proper workmanlike manner plus the removal of nonconforming structures and improvements. ESTIMATED COST OF IMPROVEMENTS The total cost of improvements in said proposed Special Improvement District as estimated es-timated by the City Engineer is $286,497.85, of which the Municipality will pay $27, 1,00.. QO and the SJate of Utah will pay $96,404.96 (approximately $84,503 from the Department of Transportation Transpor-tation and approximately $11,901.00 from Class "C" Road . Funds (Safety modification Fund), leaving a remainder of $162,992.89 which shall be paid by a special tax to be levied against the property abutting upon the streets to be improved or upon property which may be affected or specifically benefitted by such improvements. The property owners' portion of the total estimated cost of the improvements will be financed during the construction construc-tion period by the use of interim warrants. The interest on said warrants will be assessed to the property owners. The State ot Utah will pay a portion ot the costs ot these imptovements (Salety Modification Funds) In the case of replacement of drive approaches tot property owners along streets listed ,n "A" above, the Stat. ASSESSMENTS AND LEVY OF TAXES It is the intention of the City Council of Farmington City. Utah to levy assessments as provided by the laws of Ulah on all parcels and lots of real property within the Districi. The purpose of the assessment assess-ment and levy is to pay those costs of the subject improvements which the Municipality will not assume and pay. The method of assessment as-sessment shall be by lot as set forth herein. The assessments may be paid by property owners in ten (10) annual installments with interest on the unpaid balance at a rate or rates not to exceed nine percent (9) per annum as fixed by the City Council, or the whole or any part of the assessment may be paid without interest within fifteen (15) days after the ordinance levying the assessment as-sessment becomes effective. The assessments shall, be levied according to Ihe benefits to be derived by each property within the District. Other payment provisions and enforcement remedies shall be in accordance wilh Chapter 16 of Title 10 of Ulah Code Annotated, (1953), as amended. A map of the proposed District, Dis-trict, copies of plans, profiles and specifications of the proposed improvements and other related information are on file in the office of the City Recorder who will make such information available to all interested persons. TIME FOR FILING PROTESTS Any person who is the owner of record of property to be assessed in the Special Improvement District described in this Notice of Intention shall have the right to file in writing a protest against the creation of Special Improvement District No. 79-1 or to make any other ob jections relating thereto. Protests shall describe or otherwise identify the property owned of record by the person or persons making the protest. Protests shall be filed with the City Recorder of Farmington City, Utah, on or before 5:00 p.m. on the 31st day of January, 1979. Thereafter at 7:30 p.m. on the 1st day of February, 1979, the City Council will meet in public meeting in the City Council Chambers to consider-all consider-all protests so filed and hear all objections relating to the proposed Special Improvement District 79-1.
