Show Ordinance No. 9-1-15 AN ORDINANCE ADDING A NEW SECTION TO TITLE i CHAPTER 1 OF THE PLEASANT GROVE CITY CODE REGULATING THE CONSTRUCTION IN CITY OWNED STREETS AND REQUIRING CITY COUNCIL APPROVAL OF ANY CONSTRUCTION CON-STRUCTION IN SAID STREET RIGHTS-OF-WAY TO BE KNOWN AS SECTION 15. SECTION 15 A. BACKGROUND WHEREAS the City is the owner of various streets and rights-of-way within the City and, WHEREAS the construction of water, sewer, telephone and power lines and similar conduits and facilities frequently results in the disruption of service already in place and, WHEREAS the City Council is desirous of regulating use and construction of facilities . and systems on said city owned righls-of-way, NOW THEREFORE, BE IT ORDAINED BY THE CITY COUNCIL OF PLEASANT GROVE, UTAH, B. COUNCIL TO APPROVE AP-PROVE CONSTRUCTION CON-STRUCTION No person, firm, corporation, or public entity shall construct any slructure, system, or facility within the righls-of-way of any city owned street without first receiving approval of the City Council and obtaining a permit therefore. This provision does not apply to maintenance of or service connections lo existing utilities or to utilities to be installed in an approved subdivision. sub-division. C. PROCEDURES FOR APPROVAL Anyone desiring lo place or construct pari or all of any syslem, facility, or slruclure wilhin the rights-of-way of any city owned street shall make application lo the City Council on forms provided by the City. The application shall be accompanied by detailed plans identifying Ihe purpose and showing Ihe location of any features of the project proposed to be placed wilhin Ihe righls-of-way area. If, in the opinion of Ihe Council, placement of such facilities or systems are in the best interest of the city and will be constructed and maintained without impairment to the health and safety and general welfare of the city residents, the I Council may authorize ' such construction I subject to any con-; con-; ditions which it deems I necessary to mitigate ; any adverse effects of 1 such construction and issue a permit ' therefore. D. EXISTING FRANCHISE AGREEMENTS AGRE-EMENTS All approvals shall be consistent wilh any existing franchise agreements. E. PENALTY r Violation of this Ordinance Or-dinance shall be considered con-sidered a Class B misdemeanor. F. SEVERABILITY If any section, subsection, sub-section, sentence, clause or phrase of this Ordinance is for any reason held lo be invalid, in-valid, such holding shall not affect the validity of the remaining portion of this Ordinance. G. CONFLICTING ORDINANCES REPEALED REP-EALED All ordinances, or resolutions, or parts thereof in conflict with Ihe provisions of this ordinance are hereby repealed. This Ordinance shall lake eft'eel thirty (30) days afler its passage and twenty (20) days afler ils publication.
