Show WANT TO DECLARE PROCEEDINGS ILLEGAL NSHVILLE, Tenn., Dec. 13. A petition pe-tition asking that the Davidson county coun-ty criminal court declare Illegal and void . the proceedings by which the case against Robert J. Cooper, charged charg-ed with the murder of Senator Kit-ward Kit-ward W. Carmack, was dismissed, was presentej this morning by all the attorneys at-torneys who represented the state In the trial in which Robin J. Cooper and his father, Duncan B Cooper, were convicted, and by Sam C. Carmack, brother of Senator Carmack. It charges that the etfort to acquit the defendant was a fraud upon the state, done without the knowledge of anv lawyer re-presenting the state, and without conference with any witnesses wit-nesses for the state. Judge A. Neil refused to allow the petition to be flK-d. The next move will be to take the case before the supreme court on a wilt of certiorari. |
