Show ' DISMISSED JUROR ARRESTED. FOR PERJURY Nashville. Jan. 28 When the trial of Colonel Duncan Cooper, Robin t Cooper and John D. Sharpe, charged with the murder of Former Senator E. W. Carmack, was resumed today, the charges against Jurors Leigh and j Jackson were taken up. j "I have given the case careful con- slderatlon," said Judge Hart. 'The ; charges of drunkenness is controvert- ed, but It Is evident that the juror Is biased, and as such the retaining of him would .make the jury a prejudiced I one. Therefore, lets excuse Mr. Leigh from service." "I ask that Mr. Leigh be held to tho grand jury on a charge of perjury," said Attorney General McCarn. "If you wish him held," answered the court, "swear out a warrant." The defense objected Rtrenuously to any such action against Leigh, bTt the attorney general left the room to Issue the warrant. Judge Hart then ordersd the charge against Juror Jaekson, accused of habitual ha-bitual drunkenness, brought to, trial. The court next read a letter from Mrs. J. M. Whltworth, paying Juror Whltworth's condition wa6 such that to have hlra serve might mean his death. The state objected to Whltworth's dismissal and the decision was put off until tomorrow. Juror Leigh was arrested in the clerk's oflice on a charge of perjury, and bound over to the grand Jury. |
