Show Plaintiff Gets Decree to Quiet Title; Defendant to Pay $1 Moss, thrust into a pipe to divert Irrigation Ir-rigation water,- resulted in a controversy contro-versy which was finally settled In tho district court this morning beforoj Judge A. W. Agec In his testimony, Jacob Thomas of Pleasant View charged his nolghbor, Amos W. Robinson, Rob-inson, with having taken his water from tho Bernard slough for a period of more than seven years. Mr. Thomas testified that at times during the seven-year period he was ill and unablo to walk to the point where the water was being diverted, but when he did make the visits, he iaiiably found heavy moss, which, he nllegd, was thrust Into tho pipe to divert the flow of water to land belonging be-longing to Robinson. When placed on tho stand Mr. Robinson Rob-inson admitted having taken tho water, wa-ter, and stated that because he had diverted di-verted tho flow for seven years he considered that the water belonged to him. By stipulation tfotwecn attorneys for both tho plaintiff and dofensc, tnc case was settled with the understanding understand-ing that Mr. Thomas may havo a decree de-cree to quiet title to the water and Mr. Robinson shall pay tho court costs and $1 as nominal damages. |
