Show I SALT LAKE DOCTOR IS . ARRESTED 01 A I IBIIIE H Salt Lake, Dec. 3. Dr. Herbert D. H Marshall, an osteopath, was arrest- H ed yesterday at Sabetha, Kan., H charged with the murder of Elizabeth H M. Marshall, his wife, in Salt Lake H last Sunday. Dr. Marshall was ar- H rested by the police of the Kansas H town at the request of Chief of Po- H liC6 B. F. Grant H The police and representatives of H the county attorney's office have H been investigating the death of Mrs. H Marshall and yesterday concluded H that the facts revealed by the inves- H tigation warranted the detention of H Dr. Marshall. H A. complaint charging Marshall with H murder was issued by the county at- H torney last night and Detective Har- B low D. Lyon of the police department H will leave for Kansas today to get the H prisoner. In Jail in Kansas, Marshall H protests his innocence and says he H will return to Salt Lake without the H formality of extradition. H i Mrs. Marshall died Sunday as a re- H suit of a bullet wound, thought at that H time to have been self-inflicted, cither H accidentally or with suicidal intent. H I Death was instantaneous. Her body H Ti'as discovered by her husband im- H mediately after the shot was fired, H according to his statement of the case H Etthe time of his wife's death. Dr. H Marshall declared that his wife had H been in ill health, but said that she H bad no reason for committing suicide. H ISi raid he was of the belief that the H , SiCStSng was accidental and urged H i hr.t a coroner's inquest be held. Hj I In his statement to the police Dr. H itarshall said that he was preparing H ) to so with Ills wife to call on her iB ' physician and that he had stepped out ol the room for a moment, when the fatal shot was fired. The bullet struck Mrs. Marshall in the back of the head. It was pointed out that there was no powder burn on the hat, H clothing or hair, as would have un- H doubtedly been the case had the worn- H an herself fired the shot. Dr. Mar- H ' shall contended thai it was probable H that she was preparing to put the H gun away when it slipped from her H hand and was discharged, the bullet H fatally wounding the woman. H In his statement to the police, Mar- H shall said that he had made an ap- H pointment with Dr. Van Cott by tele- H 'phone shortly before the shooting, B that he had returned to the room and H had gone out again when he heard the H A strong bit of evidence against Dr. H Marshall is the statement of Hoy H ' Goldberg, who lives at the hotel in H ' which the shooting occurred. Goldberg B. said he heard the shot fired about H , ten minutes before 12 o'clock noon H last Sunday. He said ho heard Mar- H i shall walk along the hall and go to H the telephone. He heard him, he H says, telephone Co Dr. Van Cott and B make an appointment to see him. H Then, he says, the doctor went back H down the hall to the lavatory. In a 1 moment or two Marshall and Goldberg H i went into the rooms occupied by Mr. H and Mrs. Marshall. There they found H Mrs. Marshall lying on the floor, a j bullet wound in the back of the head 1 and a pistol lying on the floor a short H distance away. B Another feature of the disclosure's H made by the investigators is the fact H that the pistol was extremely difficult H to fire. Police officers are of the B i opinion that a woman weakened by ill j health as was Mrs. Marshall would j i have bad difficulty discharging the H gun Hl oo |
