Show , w JURY li THE 111 CASE DIVIDED AS TD ALIBI The J. II. Martin robbery case was turned over to tho jury yesterday at about noon and long deliberation has followed. About ten days was taken up in the introduction of testimony, considerable of the time being given to explanations and demonstrations by an expert on handwriting from New York, who contended that there could bo no question but that the defendant de-fendant wrote the blackmail letters, drawing his deductions from photographic photo-graphic reproductions of standard and disputed documents, the standard writings being those acknowledged to nave oeen written uy tue ueieuaam and the disputed writings being blackmail black-mail letters addressed to prominent citizens of the city. It seems, however, that tho jury has not given much attention to the testimony of the expert, but has confined con-fined its attention largely to the testimony tes-timony respecting an alibi. This attitude at-titude is Indicated by the fact that the jurymen have called for a transcript trans-cript of the testimony respecting the alibi. There were n e witnesses who testified that the defendant was not In Ogden when tho alleged robbery was committed with only one -witness to directly CQntradict. This witness was Samuel F. Lowranco, a loan agent, who said that ho had a business busi-ness transaction with Martin in Ogden, Og-den, October 27, 1911, the day before the robbery was committed. Martin denied the transaction. At about 11 o'clock today, the jury requested a transcript of the testimony testi-mony of Lowrance and also that of F. J. Billings, a railroad conductor. Mr. Billings testified that he saw Henry Martn at Montello, October 31, 1911, and that Martin was then on his way home from California. He was certain of the date, as It was on the day his train was wrecked Ho referred re-ferred to the record of the wreck and found that It was on October 31. D. A. Creamers, also a railway conductor, con-ductor, testified that ho saw Martin at Carlin the day before and that the man was on his way home from California. Cali-fornia. Witnesses from California testified that Martin was in Sacramento Sacra-mento and Oakland in the latter part of October. oo |
