Show uu MOTION FOR NEW TRIAL FOR SCHMIDT Los Angeles, Calif., Jan. 12. Arguments Argu-ments were to be made today in the superior court on the motion for a new trial for Mathew A. Schmidt, who was convicted a fortnight ago on a charge of murder in connection with the dynamiting of the Los Angeles Times building, October 1, 1910. The motion was based chiefly on tho alleged al-leged misconduct of the jury. David Caplln, jointly indicted with Schmidt, also was to appear at the same time to have his trial set. In deferring sentence in Schmidt's case on January 3, when the motion for a new trial was filed, Judge Willis Wil-lis announced that it would be Imposed Im-posed today unless the motion was sustained. The jury fixed the penalty at life imprisonment. |
