Show IDAHO POWER BARRED FROM TOWN OF BUHL Boise, Idaho, April 9 The public utilities commission of this state has just issued an order barring the Idaho Ida-ho Power & Light company from entering the town of Buhl, in Twin Falls county, and ordering it to cease active operations in the further construction con-struction of Its power lines into that territory. This is the second move of the commission against the Idaho Power &. Light company. It Is the commission's findings on the complaint com-plaint of the Great Shoshone & Twin Falls Power company, a rival power corporation now in control of the Twin Falls country, that the Idaho Power & Light company had not (secured (se-cured a certificate of public convenience conven-ience and necessity permitting it to enter that field. The commission upholds up-holds the complaint. Some time ago the commission Issued Is-sued an order prohibiting the Idaho Power & Light company from entering enter-ing the city of Twin Falls because It has not applied for or secured a cer-j tlficate of public convenience and necessity. At the same time the com-J mission barred the Beaver River Power company from entering the city of Pocatello on the same, grounds. The Southern Idaho Power company is in control of the Pocatello Poca-tello field. The Idaho Power &. Light company and the Beaver River Power company-carried company-carried an appeal on an application for review of the commission's order to the supreme court of this state and thereby instituted the first test on tho right of the commission to issue such an order. It is contended by the two companies com-panies in the application for review that the act creating tho public utilities utili-ties commission is unconstitutional, and for that reason the commission has no right to act on any matters pertaining to the control of public I utilities.
