Show HEAVY FINE AGAINST BAJTH . ,CharJos Barlh was sentenced to serve a hundred days on the rock pile by. Judge J. D. Murphy, in the Police-court this morning, for striking his wife during a family quarrel in which a step-child figured as the disturbing dis-turbing element y Barth was charged with disturbing the peace and entered a plea of not guilty when the complaint was read." Mrs." Sarah Barth, wife of the defendant, defend-ant, and ber son by a former husband, appeared as witnesses for the city. On the stand Mrs. Barth told of having hav-ing quarreled with her husband because be-cause of his attitude toward her child and that during the quarrel Barth had struck her In the face with his hand. The women stated that her husband was sober at the" time and that he was not a drinking man. She said that his greatest fault was his temper tem-per When the boy took the stand he told of haIng heard his parents quarreling quar-reling but did not know that his stepfather step-father had struck his mother until he was told of it afterwards. The husband took the stand himself him-self rather defiantly and made no effort ef-fort to conceal his part In the fracas. He told of quarreling with his wife and of calling her names He said he swore because his wife had bantered him to swear. He admitted that ho had slapped his spouse in the face and attempted to justffy this act by stating stat-ing that he had a nervous temper which he could not always contiol. The prisonors face " was badly ibrulsed and he said that the bruise's were caused by the arresting officer having struck him a number of times In theface.
