Show CITY HAS THE RIGHT TO PASS ORDINANCE Salt Lake, July 29 Holding that the city has a right to pass ordinances regulating gambling not specified in the state law and that the city court has jurisdiction in the prosecution of such cases as may come up under such ordinances. TI Carrlgan. scpklns a restraining order to prevent ludge J M Bowman of the criminal division divi-sion of the clfv curt from trying him on the chargo of operating a poolroom pool-room By th,s action the issue was decided In favor of the city Carrlgan. through his attorneys, gave notico of appeal and a stay of five daj'6 was granted for the preparation prepara-tion and filing of an appeal in the supreme court Carrlgan, who wab arrested on the accusation of conducting a pool-selling establishment in the roar of 225 South main street, asked for a restraining re-straining order or writ of prohibition restraining the city court from trying the case It was argued that tho city had nCt the authority to pass the ordinance or-dinance under which he was arrested and tho city court, therefore, had not jurisdiction in the matter. |
