Show o Legal Rights Of The Fisherman Some years ago a decision was handed down by a district court in Salt Lake county that so long as a fisherman remains between the marks of the normal high water lines he may follow the stream to fish. This does not give him privileges on the bank. This decision has been generally taken for granted throughout through-out the state, though there has been some demur, and the matter has never nev-er been definitely stated. However, in streams that are state waterways and . particularly in streams that have been planted with fish, a man would be running little chance of being found in the wrong if he remained in the stream to fish so long as he is not damaging property. pro-perty. If sued, it could be only for the actual amount of the damage. If, however, the stream should rise' in a man's property and not connect with any other stream, the owner could, by securing a license exclude others from fishing and operate his own private fish pond. The state waterways are for the use of the citizens of the state within legal rights." |
