AN ORDINANCE AN ORDINANCE TO REGULATE THE PRODUCTION, TRANSPORTATION, TRANSPORTA-TION, PROCESSING, HANDLING, SAMPLING, EXAMINATION, GRADING, GRA-DING, LABELING. RE-GRADING, 1ND SALE OF MIILK AND MILK PRODUCTS; THE INSPECTION OF DAIRY HERDS, DAIRIES, AND MILK PLANTS; THE ISSUING AND REVOCATION OF PERMITS TO MILK PRODUCERS AND DISTRIBUTORS; DISTRIB-UTORS; THE PLACARDING OF RESTAURANTS AND OTHER ESTABLISHMENTS ES-TABLISHMENTS SERVING MILK OR MILK PRODUCTS, and the fixing fix-ing of penalties. BE IT ORDAINED BY THE CITY COUNCIL OF DELTA, UTAH. Section 1, The production, transportation, trans-portation, processing, handling, sampling, examination, grading, labeling, regrading, and sale of all milk and milk products sold for ultimate consumption within the city of Delta, Utah, or its police jurisdiction, the inspection of dairy herds, dairies, and milk plants, the issuing and revocation of permits to milk producers and distributors, the placarding of restaurants and other establishments serving milk or milk products, and the fixing of penalties shall be regulated in accordance ac-cordance with the terms of the unabridged un-abridged form of the latest edition edi-tion of the United States Public Health Service Milk Ordinance, a certified copy of which shall be on file in the office of the City Recorder: Record-er: Provided, That the blank spaces following the words "city of" in said unabridged form shall be understood to refer to the City of Delta, Utah: Provided further, That in Section 7, item lr, of said unabridged form the abortion-testing abortion-testing requirement shall be effective effec-tive within one year after the adoption ad-option of this ordinance- Provided further, That Section 8, 16 andl7 of said unabridged form shall be replaced, respectively, by sections 2, 3 and 4 below. Section 2, From and after six months from the date on which this ordinance takes effect, no milk or milk products shall be sold to the final consumer, or to restaurants, rest-aurants, soda fountains, grocery stores, or similar establishments except Grade A Pasteurized milk: Provided, That when any milk distributor dis-tributor fails to qualify for the a-bove a-bove grade the health officer is authorized to revoke his permit, or in lieu thereof to degrade his product pro-duct and permit its sale -during a temporary period not exceeding 30 days or in emergencies such longer long-er period as he may deem necessary. necess-ary. Section 3, Any person, firm, or corporation violating any provisions provi-sions of this ordinance shall upon conviction be punished by a fine in any sum not exceeding $50.00. Section 4. In the opinion of the City Council of Delta Citv, it is necessary to the peace, health, and safety of the inhabitants of Delta City that this ordinance becomes effective immediately. Section 5. All ordinances and parts of ordinances in conflict with this ordinance are hereby repealed and this ordinance shall be in full force and effect immediately upon its adoption and first publication. Section 6. Should any section, paragraph, sentence, clause or phrase of this ordinance, be declared de-clared unconstitutional or invalid for any reason, the remainder of said ordinance shall not be affected affect-ed thereby.
