Show ORDINANCE AN ORDINANCE LEVYING A TAX AND FOR THE ASSESSMENT ASSESS-MENT OF PROPERTY IN SEWER DISTRICT NO. 2-48 FOR THE PURPOSE OF CONSTRUCTING AND LAYING SEWER MAINS IN SAID DISTRICT IN CEDAR CITY, UTAH. Be it ordained by the City Council of Cedar City. Utah: Section 1. That the City Council Coun-cil of Cedar City, Utah, docs hereby levy a tax and provide for the assessment of the same upon the property hereinafter described In Sewer Extension District No. 2-48 for the purposes of constructing and laying sewer laterals, including manholes, flush tanki, Y's for connections, for a complete sewer system, and against the following described de-scribed property: Beginning at a point south 3779.28 feet and west 718.01 feet from the northwest corner of Hock 3-1, Plat "B" Cedar City Town Survey and running thence on the following traverse; North 233.0 feet; east 500.00 feet; South 446.0 feet; west 500.00 feet; north 233 feet to the place of beginning. begin-ning. ALSO: Beginning at a point south 2392.64 feet and west 2290.87 feet from the northwest corner of Block 34, Plat "B" Cedar City Town Survey and running thence on the following traverse: East 466 feet; south 701.0 feet; west 466 feet; north 701.0 feet to the place of beginning. ALSO: Beginning at a point south 360.0 feet and west 2623.0 feet from the northwest corner of Block 34, Plat "B" Cedar City Town Survey and running thence on the following traverse: East 466.0 feet; south 980.5 feet; west 466.0 feet; north 980.5 feet to the place of beginning. ALSO: Beginning at a point south C64.5 feet and west 1391.87 feet from the northwest corner of Block 34, Plat "B" Cedar City Town Survey and running thence on the following traverse: North 233.0 feet; east 663.93 feet; south 466.0 feet; west 663.93 feet; north 233.0 feet to the place of beginning. begin-ning. ALSO: Beginning at a point north 299.0 feet and west 3384.2 feet from the northwest corner of Block 34, Plat 'B" Cedar City Town Survey and running thence on the following traverse: South 499.0 feet; west 233.0 feet; north 499.0 feet; east 233.0 feet, to place of beginning. This tax is levied to defray the expenses of digging the sewer, sew-er, trenches, purchasing and lay-. lay-. ing the sewer pipe, construction of manholes and installing flush tanks, Y's and necessary connections, con-nections, and the back-filling of sewer trenches and other necessary neces-sary construction expenses for in-stallating in-stallating the sewer system complete com-plete according to the terms of the contract heretofore entered Into between Cedar City, Utah, and Chester Parry, Contractor; also for the costs of engineering, Inspection,' publishing and mailing mail-ing notices, and making the levy and for the payment of said contractors. con-tractors. The sewer mains have been laid opposite the property above described and in the following named streets: Property assessed on both sides of streets: Second South Street from a point 200 feet west of the center line of Third West Street and to Fourth West Street; Eighth West Street between Thorley Avenue and First South Street; Ninth West Street between Center Cen-ter Street and a point 360 feet south of the south line of First North Street; Harding Avenue between be-tween Fourth West Street and Sixth West Street; First North Street between Twelfth West Street and a point 233 feet west of the center line of Twelfth West Street It is hereby adjudged that the property above described will be especially affected and benefitted benefit-ted thereby to the full amount of the tax levied, and said parcels par-cels of land are hereby assessed ' at an equal and uniform rate in accordance with the linear foot frontage of the property affect ed and above described, and the tax hereby levied and to be as sessed upon said parcels of land Is $3741.44 for the total costs of construction and materials, plus the actual expenses for engineer ing, inspection, publishing and mailing notices, and making the levy or $2.29 per front foot of abutting property, which is the total abutter's portion of said Improvement, and the City Treasurer Treas-urer is hereby authorized and directed to assess in accordance with the provisions of this Ordinance Ordin-ance for the purposes herein mentioned, all of the above described de-scribed property. Section II. The assessment list made by the City Engineer of Cedar City, Utah, as corrected, approved and completed by the Board of Education and Review, of the property described In Section Sec-tion I, for the purpose of installing install-ing said sewer mains, Is hereby confirmed, and the report of the Board of Equalization and Review Re-view to the City Council of Cedar City, Utah, Is hereby ratified, approved ap-proved and confirmed. Section III. Said tax shall be payable in not more than ten (10) equal annual Installments from the date this Ordinance becomes effective with Interest on the whole sum unpaid at not to exceed 7 per cent per annum until paid, payable annually, one or more such installments, in the order payable, or the whole tax, may be paid without interest within fifteen (15) days after this ordinance becomes effective; one or more installments, in the order In which they are payable, or the whole special tax may be paid after said fifteen (15 days) and before the first installment becomes due and payable by paying the same with interest from date of levy to the date such first installment is due; one or more Installments, In the order in which they are payable, or the whole special tax, may be paid on the date any Installment becomes be-comes due by paying the amount thereof and Interest to the date of payment; default In the payment pay-ment of any such installment of principal or interest,, when due, shall cause the whole of the unpaid un-paid principal or Interest to become be-come due and payable immediately, immedi-ately, and the whole amount of the unpaid principal or interest shall thereafter draw Interest at the rate of 10 per cent per annum an-num until the date of the sale of the property assessed, but at any time prior to the date of the sale of said property, the owner may pay the amount of all unpaid un-paid installments past due, with Interest at the rate of 10 per cent per annum to date of payment pay-ment on the delinquent installments install-ments and all accrued costs, and shall thereupon be restored to the right thereafter to pay, in installments, in the same manner man-ner as if a default had not occurred. oc-curred. It being deemed necessary for the immediate preservation pre-servation of the peace, health and safety of Cedar City, Utah, and its inhabitants that this ordinance or-dinance become operative immediately im-mediately upon publication PASSED AND APPROVED by the City Council of Cedar City, Utah this 16th day of December, 1918.
