State Street Salt Lake City, Utah 84 147 NOTICE To all the following named contestees: Charles C. Graeber, William H. Hyer. Fred Jimenez, Hulbert Smith, and all unknown heirs, devisees, assigns and others asserting an interest in the claims, the 'subject of this contest set out below; Notice is hereby given that pursuant to Title 43 CFR, Subtitle A, Part 4, Subpart E, the United States of America has instituted the following contest against unpatented mining claims on land within the Capitol Reef National Park in Garfield County, Utah (Contest 10745) involving the Copperhead Nos. 1-22, Copperhead Nos. 1-10 (amended), and Copperhead No. 1 (relocated), located in Sees. 24, 25. T. 33 S., R. 7 E., SLM. and Sec. 30, T. 33 S., R. 8 E., SLM; Burr Nos. 1-15, and Burr Nos. 1 and 2 (amended), located in Sec. 25, T. 33 S., R. 7 E., SLM, and Sec. 30, T, 33 S.. R. 8 E., SLM. The complaint filed in the above contest alleges that: (A) Minerals have not been found within the limits of the claims or any one of them, or sufficent quality and - or in sufficient quantity to constitute discovery under the mining laws of the United States. IB) The claims, and every one of them, were not located in good faith. (C) The claims, and every one of them, were not properly marked and located under the laws of the State of Utah, and of the United States, by the erection of monuments and the staking of corners. (D) The claimant has failed to substantially comply with the requirements for annual assessment work on each of the claims provided by law. (30 U.S.C. 28; 43 CFR 3851.1). (E) The land embraced within the claims is nonmlneral in character. The above contest is pending in the Utah State Office, Bureau of Land Management, Department of the Interior, P. O. Box 1 1505, 125 South State Street, Salt Lake City, Utah 84147. Unless an answer is filed in that office within thirty days of the date of the last publication of this notice as stated below, the said allegations will be taken as admitted and the contest will be decided without a hearing. This notice of publication shall not be interpreted as an extension of time to any contestee named above who was personally served a copy of this complaint to file an answer. J. K.
