But the most important part of the trip for Olch, lobbying the I.O.C., will be over before the Opening Ceremonies. In fact, Olch will be on his way home again long before the games are over. As far as he is concerned, Budapest will be Park City's last chance. "If we aren't selected I think it would be really hard to go for a third bid. This is a small community and it has already made so many sacrifices." In retrospect, Olch is philosophical about the loss to Japan. "We had a great bid. We didn't make a lot of errors. But you really can't control how these people will vote. There are 90 representatives from all over the world and they all have different agendas." Looking at the latest list of competing cities Olch attempted a bit of pre-game conjecture. Ostersund, 'Sweden, he says, has an excellent bid but may lose some support because it is so close to Norway and there is some sentiment for moving the games around the world. 's claims are based on a violation of their constitutional and federal statutory rights and therefore the case should be heard in a federal court. "In order to avoid any risk of confusion between the federal and state theories, we would prefer to have a federal judge more familiar with federal constitutional and statutory claims address those issues," Burnett said. "From our standpoint, we want the federal courts to address federal issues." Specifically, Burnett said that Johnson Intl. is claiming that Summit County, through its land use plan, has violated their rights according to the Fifth and Fourteenth Amendments to the Constitution and the 42nd United States Code, sections 1983 and 1988. Since these are federal issues, the county would simply like a federal court, which is more familiar with them, to hear the arguments. While the members of Summit County government who have been named in the suit have not yet been served because the county filed the motion to move the case to a federal court, Burnett said he fully anticipates service in the next week or two. It is conceivable that the anticipated court battle Johnson Intl. has promulgated may never take place. Burnett said that Summit County "would anticipate filing a motion to dismiss" the case based on a couple of issues. The first, that of a legal term called ripeness, refers to whether or not the plaintiff has exhausted all avenues of appeal available on a local level before filing suit. Johnson Intl. is currently in the middle of the Snyderville Basin General Plan amendment request But, according to Judge Michael Burton, questions regarding title to the property were irrelevant to the matter at hand. According to Gordon Strachan of the Park City law firm of Strachan and Strachan, the Kearns-Tribune suit against Park City also involved federal issues and was therefore removed to federal court. Strachan, who handled the Kearns-Tribune case for Park City, said perhaps Johnson's law firm of Van Cott, Bagley, Cornwall and McCarthy should have been aware of this and drafted their complaint so that the case could not be removed. "It's surprising to me that Johnson's counsel didn't find a way to draft around it," Strachan said, adding that he felt Johnson "has been poorly advised," by Van Cott, Bagley. Strachan also said the motion to dismiss on ripeness and finality issues which Burnett indicated the county would file was the same course of action taken by the defendants in the. Kearns-Tribune Kearns-Tribune suit. In what may have been an omen of things to come for Johnson Intl., the Kearns-Tribune Kearns-Tribune suit was dismissed by the federal court. He feels that the role of a defense attorney is to educate the client and allow him to make the decision, adding that he will advise his clients if he strongly disagrees with their decision. As for the specific case of James Holland, Levine said that he has given him a competent and thorough defense throughout the entire case. As evidence he points to the fact the Supreme 'Court had no problem with his work at the first penalty hearing for Holland, which was vacated due to errors made by the court. Levine said that the judge for the Holland case was the same throughout the entire process, so he had a full knowledge of all aspects of the case without going over it again. Their only complaint is that Summit County isn't paying their public defender enough." ; Levine said that he has received a great deal of support from former clients and other attorneys since his situation became public knowledge, and has even received a letter of support from Holland as well.
