Show ORDINANCE NUMBER 3-68 AN ORDINANCE VACATING VACAT-ING A PART OF SPRING TERRACE AVENUE IN SPRINGVILLE, UTAH BE IT ORDAINED BY THE CITY COUNCIL ,OF THE CITY OF SPRINGVILLE, UTAH. SECTION I. Pursuant to an order of the Springville City Council, notice was given of its intention to hold a public hearing hear-ing on the question of vacating a part of Spring Terrace Avenue Av-enue by publishing such notice in the Springville Herald once a week for four consecutive weeks, beginning October 10, 1968, and by mailing copies of such notice to all owners of record of land abutting that part of said street proposed to be vacated to the mailing address ad-dress appearing on the rolls of the Utah County Assessor. Said public hearing was duly held on the 4th day of November, 1968, at 7:30 o'clock p.m. in the Council Chambers, Springville Spring-ville Civic Center, 50 South Main Street, Springville, Utah, and all interested persons attending at-tending said meeting were heard. SECTION 2. The matter of vacating that part of Spring Terrace Avenue set forth in said notice having been duly considered by the Springville City Council, said City Council Coun-cil finds that there is good cause for such vacation and that the same will not be de- trimental to the public interest. SECTION 3. As to that part only of Spring Terrace Avenue, Springville, Utah, hereinafter described, the Springville City Council hereby revokes its acceptance ac-ceptance thereof, relinquishes the City's fee therein, and declares de-clares the same vacated. That part of said street hereby vacated va-cated is described as follows, to-wit: Beginning at a point in the South line of Spring Terrace Ter-race Avenue, Springville, Utah, which point is South 5198.0 feet and West 1574.2 feet and North 39 deg. 02' . West 132.4 feet and South 52 deg. 22' West 72.5 feet ' and North 83 deg. 36' West 84.5 feet from the Northeast North-east corner of Section 3, Township 8 South, Range 3 East, of the Salt Lake Base and Meridian (which point of beginning is also the Northwest corner of Lot 1, Spring Terrace Subdivision, Sub-division, Springville, Utah, according to the official plat thereof on file in the office of the Recorder of Utah County, Utah) : thence North 83 deg. 36' West 50 feet to the West line of said Avenue; thence South 5 deg 58' East 303.7 feet; thence Easterly 50 feet more or less to an angle corner and the West line of Lot 4, Spring Terrace Subdivision, S p r i ngville, Utah; thence along the West lines of Lots 4, 3 and 1 of said Subdivision North 5 deg. 58' West 313.54 feet to the South line of said 3 p r i ng Terrace Avenue and to the point of beginning. begin-ning. SECTION 4. The land includ ed in that part of said street hereby vacated having originally origin-ally come from the parcel of land bordering the same on the east, the Springville City Council, Coun-cil, insofar as it may legally do so, hereby relinquishes and quit claims its fee in said street to the present owners of the respective lots in the Spring Terrace S u b d 1 v i sion, Springville, Utah, abutting on that part of said street vacated, vacat-ed, and declares the respective West lines of each of said abutting lots extended to the West side of the abandoned street. SECTION 5. In the opinion of the Springville City Council, it is necessary for the immediate immed-iate preservation of the peace, health and safety of the municipality munic-ipality of Springville that this ordinance become effective upon up-on the date of its first publication. publi-cation. SECTION 6. The City Recorder Re-corder of Springville is hereby directed to have this ordinance published in the Springville Herald, a newspaper published within the City of Springville, Utah, on December 5, 1968. and to cause a copy of this ordinance or-dinance to be recorded in the office of the Recorder of Utah County, Utah.
