Show bUV. CUTLER WANTS COAL LAND ACTION Regarding coal land and other mineral min-eral land conditions in I'tah. (inv. Joha C. Cutler yesterday sent a communication communica-tion to the Senate and the House. The document recites a general his'orv t the lands and recommends certain measures. The communication is as follows: fol-lows: T have the honor to presenf to the honorable hon-orable Legislature of the State of I'tah. the following recital of facts and accompanying accom-panying surest ion.', rnrrainlng to the matter or mineral lands In the State: On or atout the fifth dav of November. 19"4. the State Board of Ind Commissioners, Commis-sioners, by Its president. Hcber M. Wells, and Its secretary, Byron Gpki, entered into a contract to sell to George T. Badger Bad-ger certain lands which, according to the numbers of the respective sections, are school lands within the meaning of the Enabling Act. This contract was later transferred to Mr. Badger by Mr. Arthur Sweet, and by him It was caned out. the full amount charged by the Land Board for said lands, principal and interest having hav-ing been paid by Mr Sweet on January 4. 1917. On completion of this payment. Mr Sweet requested that patent for the lands be issued to him. In the interim between the making of the I'oiitnii mid the completion of the payment fr the lands, the government, through its attorney. Intervened and asked thai the patent be not granted, basing Its request on the giound that the Intent of the Knahling Act was not to five to the State for school purposes, lands rhe chief value of which consists In their mineral deposits; but that wher-e wher-e er lands nr found to con'aln n ineial. the State i:as nn authority to sell them Accordingly, complaint is now tiled in the ("ircuit Court of the l"nitei States. 'In view of these facts, and others which may appear, hy which the Governor mav be prevented from Issuing patents for lands purchased and paid for.
