Show ASKS STATE TO FIGHT THE CASE The special joint committee appointed by the Senate find the House of Representative Repre-sentative to investigate into the condition condi-tion of the coal lands of Utah and the rights of the State to the lands under the enabling act, which transferred all lands to I'tah, will on Mondav make its report. The status of the State's title will he given in a report which will be presenter by the chairman, Xephi 1. S. ('. Jensen. The decision in the Sweet case will settle these important questions: First, the rharacter of lands which the State can hold under the grant of the en abling act. Second, how the character of these lands is to be determined. In view of the foregoing facts, it is vitally important to the State that an absolutely corretc decision be had in the Sweet case. To the end that sncb a de-cision de-cision mav be obtained, we are of the opinion that the Stride should intervene in this cae. if intervention is possible. If intervention on the part of the State is not permitted, the State should take steps to :isist Mr. Sweet in making his defense. This defense should be conducted con-ducted under the direction of the At tornev (ieneral and the State Land i 4 loarl. The case now pending in the Circuit court will in all probability be ap pealo.) to the Supreme court of the Uni ted States before the ijuestions in dis j pufe are finally decided. It will be ne- ! cesxarv to secure expert witnesses to i trive testimony in the case. The ct , penses of these witnesses will have to 1 be mot, and their ser icps paid for. ' Moreover, the A f t oi ne v-( ienera 1 will be under the necessity of employing special counsel in the case, as his regular duties du-ties will not permit hnn to represent the State personally. We therefore recommend that an ap propriation of $0000 be made, to be used under the direction of the Attor . rev (ieneral. in employing expert witnesses wit-nesses and special counsel.
