Show WHITEST THELAW Justices' Tangle Is Now in the District Court's Hands. City Attorney George L. Nye began mandamus proceedings today against Justice of the Peace Frank H. Clark and Justice of the Peace Gustave Kroe-ger, Kroe-ger, to compel them to turn over the papers and dockets of their offices to the City court. v By taking this matter into the District court the constitutionality of the new law, regarding both the doing away with all of the four Justices and also the limiting of the Justice to Jurisdiction in cases iot exceeding $10 will be tested. Justice F. H. Clark, who was elected. Justice for the whole city in November, takes the stand that he is not only his own successor, but the successor of the other four Justices, and that the law does not contemplate the turning over of his papers to the City court. Justice Kroeger intends to test the constitutionality of the law abolishing his office and has engaged Powers, Straup & Lippman to fight the case for him, and will hold his office until ordered or-dered to surrender by the higher court. Justice Nielsen has withdrawn from the fight and turned his official papers over to City Recorder Nystrom yesterday. |
