Show WATERWORKS CASE AGAINST OGDEN CITY Judge Hall has rendered a decision In the second trial of the case of the city of Ogden against the old Bear Lake and River Waterworks and Irrigation company, com-pany, which Ja now the Bear River Irrigation Irri-gation -and Ogden Waterworks company, reversing the decision rendered by Judge Hlles on the first trial, and deciding in favor of the defendants. The suit was brought for the recovery of the waterworks water-works system and damages to the equipment equip-ment Judge Hall held that the city was' aware of all steps taken from the time the system sys-tem was turned over to the company until un-til the city began suit for recovery. The city was aware that the company expended expend-ed large sums of money in Improvements, and that Ogden city levied and collected . taxes on the new system until 1S97. The city is estopped from claiming to own any part in the new waterworks system. The city has all costs to pay. v When the case was first tried Judge Hlles entered a decree in favor of the city. The case was appealed to the Supreme Su-preme court, the Judgment reversed and the case remanded. Judge Hall's decision Is the result of the new trial. |
