AJac, appellants, Robert Kirk, defendant, defend-ant, Andrew Kirk, tntervenor, the Judgment of the lower court Is affirmed af-firmed The suit was brought ot. recover possession pos-session of 2T22 head of sheep or their value. It was alleged in the complaint that the sheep were leased to Robert Kirk by Wetzell and others on September Septem-ber 27. 1901, and that In August. 1902. the defendant borrowed $2500 from the bank and gave a chattel mortgage on the sheep as security. Kirk is alleged to have then disappeared, leaving the sheep in charge of herders. The bank then seized the sheep and sold them. Suit was filed to recover the sheep and Judgment was rendered in favor of the plaintiff for $.'562.92 and In favor of the Intervener for $67.26. The judgment is sustained by the Supreme court. |
