Mackenzie, secretary of the Utah chapter of the American Alining congress, to file before the first of the year claims for exemption from assessment assess-ment work for 1910, as provided for under un-der the joint resolution passed bv congress con-gress and signed by President Wilson November 13. Exemption from doing tho $100 work on each mining claim was provided for in a joint congressional resolution. This resolution, which was passed at the request re-quest and with the backing of tho mining min-ing associations of Montana, Idaho and Utah, provides exemption for all mining j claims, regardless of the number held bv any one claimant. A joint house resolution passed bv congress in August of this j ear provided exemption for five claims by one claimant. claim-ant. The recently enacted resolution is not an amendment to the old resolution and the Question has arisen whether or not it will be necessary for persons who claimed exemption under the August legislation leg-islation to again fiie under the newly passed measure. Jn order to bo on the safe side, Sir. Mackenzie has advised claimants to file under tho new law. Although tho resolution itself makes no mention of the necessity of making an acknowledgment of the exemption application ap-plication before a notary public, Mr. Mackenzie advises that this step be taken as a precautionary measure in case of any contest. According to tho word- I ing of the resolution, the paper is simply filed and not recorded in the clerk and recorder's offices. Tne te.t of the joint resolution follows: "Be it resolved by the senate and house of representatives of the United States of America in congress assembled, That the provisions of section 32-1 of the Tic-vised Tic-vised Statutes of tho United States, which requires on each mining claim located lo-cated and until patent has been issued therefor, not less than $100 worth of labor la-bor to bo performed, or improvements aggregating sucit amount to be made each year, be, and the same is hereby suspended as to all mining claims in the U nited Slates, Including .A laska , during the calendar year provided, that every claimant of such claim in order to obtain the benefits of this resolution shall file or cause to be filed in the of- ' fice where the location notice or certificate certifi-cate is recorded on or before December 31., 1919, a notice of his desire to hold said clai m under this resolu tion." According to Mr. Mackenzie, the fo!- 1 lowing is the correct, form of notice of intention to hold min ing claims under the provision of the joint resolution; Know all men by these presents.
