Show DISMISS CHARGE UNDER SHERMAN LAW NORFOLK, Va., Oct. 29. Federal Judge Waddell today dismissed an indictment in-dictment recently returned against Col-pate Col-pate & Co. for alleged violation' of the Sherman law. This action was on a de- . niurrer by the company, which the court sustained. Judge Waddill sustained the contention of the company that a manufacturer, provided pro-vided he is not in conspiracy with other manufacturers of similar products, lias the right to fix and enforce the maintenance mainte-nance of reasonable and fair prices and that such a manufacturer is violating no law in refusing to soil again to a retailer re-tailer who falls or refuses to maintain such a fixed price.
