Show TELEPHONE COMPANY SUED BY ATTORNEY Asks Court to Enjoin Defendant From Collecting Service Charges in Advance. D. A. Skoen, a Salt Lake attorney, filed suit yesterday in the civil division of the city court to enjoin the Mountain Moun-tain States Telephone & Telegraph company com-pany from collecting the charge for service ser-vice of his residence telephone in ad-vauce. ad-vauce. A temporary restraining order was issued by the court and served on officials of the telephone company. Appearing as plaintiff and counsel, Mr. Skeen charges that the company has frequently endeavored to enforce a rule requiring that payment for telephone tele-phone service be in advance, in making collections of the charge against him for a telephone at his residence, 1093 Tenth East street. The Tule is referred to in the complaint as ''arbitrary, unjust un-just and unreasonable.1' The plaintiff asks that the temporary restraining order issued yesterday by Judge Wilkins be made permanent and that the company be enjoined permanently perma-nently from removing the telephone from his residence or denying him service ser-vice upon his refusal to make payment in advance. It was stated by an official of the telephone company last night that the ; telephone had been disconnected on j March o and that the service would not be restored until the case was final- j ly adjudicated. |
