Show DISPUTES TESTIMONY IN MOONEY TRIAL PAX FRANCISCO, Feb. 13. An affidavit affi-davit disputing material testimony offered of-fered at the trial of Tliomas J. Mooney, convicted last Friday of first-degree murder for his connection with the preparedness pre-paredness day bomb explosion here last July, when ten persons were killed, was made today by Mrs. Richard Earl La Fosee, formerly of Portland, Ore. She alleged in the affidavit that she saw Frank C. Oxman, on Oregon cattleman, the prosecution's state witness, on Market Mar-ket street many blocks distant from the scene of the explosion. This contradicts Oxman's testimony that he was at the scene a few minutes before the explosion and reroenized four of the five defendants defend-ants as they drove up to the curb and deposited a suit case on the sidewalk. Maxwell McNutt. attorney for Mooney, said he would introduce the affidavit in ' support of his application for a new trial. Sentencing of Mooney was postponed by Judge F. A. Griffin. Assistant District Attorney James Brcnnan said his olfice had a corroborating corrobo-rating witness who saw Oxman at the scene" of the explosion. j |
