Show TO ENJOIN USE OF HORSESJI WON City Will Enter Suit at Once Against Offending Mining Companies. Instructions to file suit immediately to enjoin the Cardiff Mining and Milling Mill-ing company and the Boston Development Develop-ment com pan', operating the Maxfield mine, from using horses for hauling ore in Big Cottonwood canyon were given the city law department yesterday morning morn-ing by the city commission. The action of the commission was taken following a report made by Commissioner Com-missioner W. It. Shearman of the waterworks water-works department to the effect that seventeen four-horse teams are hauling ore down the canyon from the Cardiff property and three from the Maxfield. Me argued that such use of horses in the canyon was in direct violation of the agreement upon which improvement of the road was undertaken at the joint expense of the county, the city and the miniug companies. The agreement was to the effect that no horses should be used for hauling ore after the road should be put in condition condi-tion for the use of motor tractors and ore cars. Trial of the tractors, however, resulted in discovery that they would not stand the grade of the road, even as improved by the expenditure of the $30,000 jointly contributed by the parties to the contract. Thin fact was laid before the city commission recently by the officials of the mining companies, at which time it was agreed that all the parties to the agreement should make endeavor to find a solution that would insure the water of the canyon against pollution such as is believed to threaten from the presence of horses in the canyon. Return to extensive use of horses, as reported by Commissioner Shearman, was responsible for the action of the commission yesterday morning. W. H. Bramel. special deputy in the city law department, was called before the commission and instructed to prepare and file a suit for injunction with all possible speed. It will probably be filed today. |
