Lewis, in passing sentence on Beatrice Bartlett, charged with conducting con-ducting a house of Ill-fame, said yesterday yester-day that the district court should not be used as an instrument to drive women Into the stockade and for that reason would impose only a nominal lino on tho woman, who was convicted In the district dis-trict court three weeks ago. He Imposed a fine of $1. Before passing sentence Judge Lewis asked Assistant City Attorney P. J. Daly If he know of any reason why only a nominal fine should not be imposed. Tho assistant city attorney suggested' that In case the court believed the woman's statement that, her arrest resulted from her refusal to move Into the stockade It was probably the duly of the court either to direct the district attorney to flic Information based on the statement made by the woman, or to Impanel a grand jury and direct an investigation. The woman was convicted previously in police court and an appeal was taken to the district court. In defense, the woman charged that tho chief of police ordered her to move Into the stockade and that her arrest resulted from her refusal to do so. After she has been convicted, con-victed, the court asked to be advised as to the truth of the woman's statement. Mr. 3aly asked that a stay be granted In order that Chief of Police S. M. Barlow Bar-low might be given tho opportunity to come into court to refute the woman's statement. Accordingly a postponement of the case was ordered until yesterday. In tho meantime Mr. Daly wrote to Chief Barlow, Bar-low, sending him a transcript of the woman'a testimony with reference to the position she alleged the police department depart-ment had taken. In court yesterday Mr. Daly produced the copy of the letter sent to Chief Barlow and 3tatod that the chief had not answered it. He said that ut present the chief of police was not in tho stale. Thereupon. Judge Lewis Imposed Im-posed the minimum Hue. |
