Show Only One Count Out of Many Found hy Grand Jury Remains Re-mains Against Financier. UPHELD IN CONCEALING THE BOOKS OF HIS FIRM Charge That Stands Is One for Alleged Conversion of Proceeds Pro-ceeds of Discounted Note. NEW YOKK, Sept. 11. The iudicl-mouls iudicl-mouls charging F. Augustus Heinze. the copper financier, with conspiracj' to obstruct the administration of justice 03' concealing the books of the United Copper company,,, was dismissed today by Judgo Hough of tho United States circuit court. The books were under subpoena of the federal court last spring, when the courts -were investigat ing Mr. Heinze 's action as president' of the Mercantile National bank in sustaining the firm of. Otto Heinze & Co. during the financial finan-cial panic, of 1907. The accounts which were wnntcd could not bo found b' the federal officers and Ileinzo's indictment followed. One Count Approved. Judge Hough today also dismissed fifteen of the sixteen counts in au indictment in-dictment also -pending' against Mr. Heinze. charging him with misappropriation misappro-priation uf the funds of the . Mercantile Mercan-tile National bank bv certifying cheeks of the liviu of Otto Heinze account One of the indictments alleged misapplication- of funds of the bank by Mr. Heinze was approved by .fudge Hough. Judge Hough in dismissing the fifteen counts of tho indictment charging misapplication mis-application of the funds of tho iiank, said that those counts seemed to charge that Heinzo for the benefit of himself and others unnamed caused the bank to discount a single name commercial paper and then lost the amount paid. The judge said that it would bo nee essatw to maintain an action for con version of 'tho proceeds of the note which he did not believe could be dune. Ho therefore threw out those counts. The sixtcciith ' count, which was retained, re-tained, charges that Heinze knew the giver of tho note was insolvent when it was discounted. The judge said this would amount to conversion. |
