Show I SCHOOL FUNDS i An Opinion Given Out by the Attor neyGeneral The attorney general yesterday handed down another opinion to the l ate suoerfntendant of schools In the matter of funds The same was In reply to 1 quetJon asked by the officer of-ficer and is as follows I am in receipt of your favor of the 11th inst asking for an opinion upon the following question The school law of ISO instructs the county treasurers treas-urers to pay to the district treasurers certain state and county school funds on the warnings of the county superintendent sup intendent of schools Now in case a I school district In any county of the state has ail remaining to its credit in the county treasury ounty treur money apportioned appor-tioned from the state and county sciiool funds how shall this money be drawn I from the county treasurer and put in possession of the district treasurer I I find by section 4 of chapter 49 of the laws of 3S97 a provision as follows The county treasurer shall receive I and hold as a special school fund subject sub-ject to the orders of the county superintendent i I su-perintendent all public school moneys from whatever source received and keep a separate account thereof and when the same Is apportioned to the school districts he shall pay i to the district treasurers upon the warrants of the county superintendent He shall on or before the 1st day of August In each year make a report to the board i of county commissioners who shall audit the same and to the state superintendent su-perintendent In such form as he shall direct showing First the amount of moneys on hand at the commencement of the school year second the amount of moneys received from the state school fund third the amount received from the county school tax fourth the amount received from other sources fifth the total expenditures for school purposes sixth the balance on hand a the end of the school year The fact that the school district had at the time this law went into effect funds to its credit in the county treasury ury the same being money apportioned appor-tioned from the s ate and county school funds could not In any way affect the operation of this law The law provides that the county treasurers shall receive and hold public school moneys from whatever source received and that he sCiall pay the same to the diSC treasurers upon the warrant of the county superintendent The language of the act seems to be clear and unambiguous and I advise you that the money in the hands of the county treasurer may b covered into the district dis-trict treasury upon the warrant of the county superintendent |
