Show I STRATTON wms I I JUDGE HALLETT GIVES A DECISION DE-CISION HT HIS FAVOR A Temporary Injunction Allowed In the Case of Stratton Against the Gold Sovereign Company Denver Colo Dec 6Judge Hallett In granting a temporary injunction in the case of Winfield S Stratton against the Gold Sovereign Mining Tunnel company et al delivered in the United j I States circuit court this morning an j important decision which will interest miners all over Colorado and the west The opinion says I It appears that the tunnel is being driven by respondents for the purpose of discovering lodes in the line thereof I of and they intend to assert the title to such as may be discovered in the I tunnel under the act of congress within complainants location and elsewhere Whether this may be done as against a I valid location on the surface of earlier date than the tunnel location is the I question at issue between the parties Assuming the John Logan location to have been well made in the month I of September 1891 and maintained thereafter the grantors of respondents I could not have afterward located the same territory by a tunnel or in any other way I Complainant alleges that he has discovered dis-covered good ore in his Logan location I and that respondents intend to assert title to it whenever they can reach it through and by means of their tunnel In any view that may be taken of the controversy an action at law would not afford adequate protection to complainant complain-ant in the claim Motion for preliminary I prelim-inary injunction will be allowed and I the order will stand until otherwise directed I di-rected = |
