Show EGG IN TON SENTENGEO f Six Years For Voluntary Manslaughter Man-slaughter of Martin Mock k s j ONE JURORS AFFIDAVIT CAUSES HIM TO BE SUMMONED BEFORE THE COURT John A Van Pelts Claim to an < Eighth Interest In the Wnnnmuck Mine Suit Against the Park City Bank Stockholders Three Cases t Argued In the State Supreme to CourtGeneral Cullings j Benjamin Egginton who was recently recent-ly convicted of the voluntary manslaughter man-slaughter of Martin Mock was yesterday yester-day brought before Judge Norrell to be sentenced First a motion for a new trial was argued by Attorney H C Edwards or behalf of the defepdant and by County Attorney Van Cott for f the state The motion was overruled and Essinton sentenced to six years imprisonment in the state prison In the course of his argument for anew S a-new trial Mr Edwards introduced an affidavit made by one of the jurors before whom the case was tried and who found Eggmton guilty The affidavit affi-davit reads as follows State of Utah County of Salt Lake ss John Watson being lirst duly sworn 011 his oath says That he was < one of the jurors who tried the above entltl > d cause that he not at time of rendering said verdict has not at anytime any-time since nor does he now believe that a the defendant was guilty of the offense as found in the verdi t of said cause or of any public offense whatever that the only conditions upon which he signed the verdict on the said cause was bv reason of an asjreeraejit and promise made by each and every one of the jurors in said cause as a condition con-dition ou his signing said verdict that tJ they would sign an application for and > recommend a pardon of said defendant JOHN WATSON In reference to this affidavit County Attorney Van Cott asked that an attachment at-tachment be Issued for Mr Watson saying that any man who would take the action Watson did as a juror and then make an affidavit of that kind ought to be given an opportunity to orplain The attachment was issued made returnable re-turnable at 10 oclock this morning BefOre sentence was passed Eggin ton made a rambling statement to the court giving his version of the shootIng shoot-Ing |
