| Show NEGOTIATIONS ARE NOW OFF J o Iro ij > oct of Immediate Settlement With Clasby Having been unable to agree upon a basis of settlement with Mr Clasby the fire insurance adjusters last evening even-ing pave up the fight for the present at least and Messrs Washburne and White left for Denver on special business busi-ness It now looks very much as though the aid of the courts mill ben be-n in the adjustment of the recent re-cent tire loss and should such be the case of course Mr Clasby being the aggrieved party will be forced to take par the initiative and endeavor to compel I the Insurance companies which held policies on his store to make the desired de-sired payments I The difference between the companies com-panies and Mr Clasby is in the very near neighborhood of 51DOOO being based upon two inventories of the stock contained In the store prior to the fire Ore of the inventories was made by A C Smith at the time of the recent suit Instituted by Mr Clasby to force a settlement of the affairs of A C Smith and company which placed the total valuation of the stock at 33 000 and the other is that of Mr Clasby contained in his books which gives tIe total as 542000 The appraIsement of the stock by three experts several days after the recent lire gave returns re-turns of 20000 and the insurance companies com-panies are willing to make settlement I on the difference between Smiths figures and those returned by the appraisers ap-praIsers To this Kir Clasby will not agree arguing that his figures should be accepted as proof of the stock contained con-tained in the store prior to the fire The gentleman refused however to make out a complete inventory of the goods held bY him before the fire giving giv-Ing as his reason that it would be impossible im-possible to give an accurate schedule of the stock at this late day He still contends that his books should be taken as authority and holds that the 19000 difference between them and those of the appraisers represents hIs I actual loss This the insurance people i refuse to believe and there the mater I rests Continental Fell Down II Members of the local Board of FIre Underwriters were yesterday hugely i enjoying a dilemma in which one o the agents of the Continental found I himself as the result of the action o f his home office in dealing with the Sanitarium risk This institution I carries 50000 insurance and some days I apo onehalf of that amount was cancelled can-celled at short rates and rewritten in I the Home and Continental each com I pany taking 12500 at n SO per cent ra I duction The solicitor for the Conti I nqntal was so certain his company would not cancel the policy that he I gave his personal guarantee to protect the Sanitarium company in the event I of any adverse action on the part of his general manager His dIscomfort I tla y be imagined when t it Js known r 1fI ih 1f > 14 i that on Wednesday the company reused II re-used to accept the risk at the cut rate and turned the agent down As the I result of some negotiating the Home took the rejected 12500 at the original I figures 50 per cent off This Is looked upon by the union agents as a sign from the Continental that it has had I about business enough of the heavy cut rate |
