Show NEW TRIAL fOR CAPTIDREYFUS Court of Cassation Has Decided Decid-ed In His Favor 4 HIS INNOCENCE IS BEYOND I BE-YOND ALL DOUBT 4 Court Martial At Rennes Ordered to Hear the c set se-t Decision Refers to Evidence Going to Show That Bordereau Was Not Written By Convicted Man But By Esterhazy and Says There Have Been Many Facts Brought Out Tending to Show That Drey f us Is Not Guilty 4 Paris June 3The court of cassation today rendered a verdict in favor of a revision of the Dreyfus case and ordering a courtmartial to sit at Rennes sixty miles from Nantes for the trial of the prisoner Previous to the announcement of the verdict crowds assembled at the palace of justice and in its neighborhood + + + + + + + + t + + + + + + + + + + awaiting the decision Perfect calm prevailed The decision which was pronounced at 340 p m says the prisoner is to be retried on the following follow-ing question Is Dreyfus guilty of having in 1S91 practiced machinations or having had communication with a foreign power or its agents with the view of facilitating facili-tating acts of hostilities in the case of a war with France or having furnished furnish-ed the means therefore by furnishing notes or documents retraced on the bordereau The audience received the decision with cries of vive la justice When the doors of the court of cassation cassa-tion were opened an immense crowd of people attempted to rush through the entrance and for a time there was great confusion and uproar The session opened at 3 oclock when the president of the court M Mazeau after reminding remind-ing the audience that all demonstrations demonstra-tions were interdicted gave judgment in the following tenor Decision of the Court The court after hearing the report of the premier president of the civil chamber the public prosecutors findIngs find-Ings and the application of Maitre Mornard counsel for Mme Dre > fus under the new article 443 paragraph 4 of the code of the criminal proceedure to the effect that a revision of judgment judg-ment can be demanded when new facts are produced or unknown documents showing the Innocence of the condemned con-demned and in view of the judgment of Oct 29 1898 rendered by the criminal chamber ordering an Inquiry declared that the demand for a revision of the Dreyfus case was presented in proper form and In view of the results ofsaid inquiry in view of the presentation of the courtmartlal of a secret document bearing the words ce canaille de d and seeing that the communication of this document is proved by the depositions de-positions of M CasimirPerier General Mercler and General Boisdeffre and seeing that M CaslmirPerier has declared de-clared he heard from General Mercler that the document bearing the words ce canaille de de submitted to the courtmartial was believed to indicate Dreyfus and that in addition Generals MercJer and De Boisdeffre whp were invited to say whether they knew if said communication had occurred refused re-fused to reply thus acknowledging it seeing that i > y the revelations subsequent subse-quent to the verdict the communion tion to the courtnlartial of a document capable of influencing their minds and now not regarded as applicable to Dr yftis constitutes a new fact calculated cal-culated to establish the innocence of Dreyfus seeing that the crime charged against DreyfuL consisted of furnishing the secret documents connected with the national defense accompanying which was a missive styled a bordereau undated unsigned and written on fillgraned matter which was no longer manufactured and that two authenticated authenti-cated letters written on the identical paper dated contemporaneously with the bordereau were discovered in the house of Esterhazy the wriUng upon which experts have declared to be the same as that of the bordereau which fact was unknown to the courtmartial tend to establish the Innocence of Drey gus seeing that the alleged confessions of Dreyfus to Captain Le BrunRenaud are disproved in View of these aegis ments and without submitting others the court quashes and annuls the Jver l T I diet of condemnation of Dec 22 1834 against Alfred Dreyfus by the first courtmartial of the military government govern-ment of Paris and sends the accused before a courtmartial at Rennes to be specially appointed to conduct the new trial This judgment is to be printed and transcribed on the docket of the first courtmarital along side the decision which Is annulled The court then adjourned |
