Johnson presented a petition from citizens of Uintah county asking that certain changes be made in the law on county seats Committee on counties ON PROBATE COURTS Mr Thurman from the committee on judiciary j reported on C F 15 a bill to authorize probate courts to grant orders in certain cases without publication recommending that the bill be rejected and offering a substitute therefor A minority report was also read recommend ing that the bill and substitute be rejected be cause theythrew down one of the safeguards to minors Mr Thurman spoke in favor of the substitute showing what he deemed to be the weak points in the bill as passed bp the Council The object of the substitute was to avoid the payment of so much money to the newspapers which especially in small estates was one of the big gest items of expense He thought the substi tute should pass Mr Kimball stated that tne minority of the committee was against any change in the pres ent law of giving notice If any law was to be passed then the substitute was to be preferred but he saw no reason why any change should be made A notice in the newspaper was much better than posting a notice at the court house but both were not too much a personal citation should be had in every case Mr Pierce also opposed the substitute or any legislation upon the subject at all Mr Creeragreed that all tbe safeguards that could be should be thrown around these mat ters but there are times when goro at hardships occur to small estates through the accumulation of so much expense This bill allows the pro bate judge to order the publication if he so de sires He thought the safeguards were amply sufficient There should be some legislation looking to the reducing of that expense The substitute bill should pass Mr Hammond favored the substitute It coy ered ample ground and assailed the rights of no one A great expense would be saved It was scandalous to think that the widow and minor heirs must pay out from the little estate left by their natural guardian from 10 to 15 per cent in order to get what rightfully belongs to them Mr Thurman was of the opinion that the sub stitute afforded much greater safeguards than the law now on the statute books He made a strong argument in favor of the substitute The report of the committee was adopted Council lile rejected and the substitute was the adopted FROM THE COUNCIL The Council notified the House that it had re ceived a communication ct from the governor to the effect that he had approved C F4 an act to validate and make tOff legal certain documents Also that the Council had receded ufrgsits amendments to H F 17 the highway bill as recommended by the conference b ill then committee The passed the House and was referred to the committee on enrollment ALLENS CITY SCHOOL BILL Mr Allen from the committee on educa tion presented the following report Your committee on education to whom was referred H F 1 a bill to establish a free school system in certain cities of the ter ritory of Utah report that they have duly con sidered the same and it report back to the i House with certain amendments herewith sented and pre the committee recommend that the i amendments be adopted and that the bill be put upon its passage The report was adopted and H F 1 ordered I printed as amended THE ABSTRACT BILL Mr Thurman from the committee on judici ary reported on H F 13 a bill authorizing the several county recorders to furnish abstracts of mortgages to the assessors of the counties in which the mortgagee resides with an amend ment malting the compensation for each abstract So cents instead of 50 cents Adopted THE CHATTEL MORTGAGE BILL The Council notified the House that it had I passed H F 1C with amendmentsthe chattel mortgage bill making the life of a
