Show By What Authority ? Fracci? Underhill was arrested by private de-tecive de-tecive Rose, and turcr.; ver to the officers to be imprisoned on the charge of larceny. The case was referred to in the Herald a couple of days ago. Underhill, better known as Frank, was a hotel waiter, and had been in the Townsend House until a few weeks ago, when he went to the Walker House. While Mr. Jones' thing3 were being moved from the Townsend, Frank, it is charged, stole a pair of diamond ear-rings valued at $360 ; a gold brooch valued at $40 and a pair of shirt studs. Rose recovered the diamonds dia-monds from the party to whom Frank had given them. Yesterday an examination exami-nation was to be had, but yesterday Mr. Rose went to the city prison, got out Underhill, had a talk with him and a confession or something, and turned him loose with tho understanding understand-ing that the criminal should leave the Territory. By what authority does Mr. ' Rose compromise a crime against the laws of the Territory ? Who em- j powered him to compel transportation against a criminal instead of imprisonment? imprison-ment? Who mado him legislator, judge, jury, and the executive officer of court rolled into one ? These are questions that demand answers. . If Francis Underhill was guilty he should have been held to answer to the law he had offended. If he were not guilty it was infamous to compel him to leave the Territory, or even to promise pro-mise ho would do so. |
