Show BLACK LAW UPHELD IN SUPREME COURT City of Boise, Idaho, to Hold Election Under Commission 'Form of Government. Special to The Tribune. BOISE. Ida.. May 2. The election under the commission form of government w.lll take place tomorrow. The supreme court, for a second time, upheld the constitutionality constitu-tionality of the Black law In an opinion given orally this afternoon from the bench by Justice James F. AHshlre, In which Chief Juntico deorga H. Stewart concurred' con-curred' and to which Justice Isaac N. Sullivan dissented. Through Us ruling the supreme court denied the petition of tho opponents of the Black law and affirmed af-firmed the opinion of Judge Carl A. Davis of the Third Judicial dlBtrlct for Ada county denying the application for an injunction to restrain the city of Boise from holding an election tomorrow, (Friday), (Fri-day), May 3. The decision wan handed down In the case of A. J Swain vs, Mayor Frltchman and Boiae city. The ruling of tho supreme court is conceded con-ceded to be a victory' for the people at large, the second Blncc the enemies of the Black law have centered their attack on this measure, which Boise took advantage advan-tage of through a vote of tho people and abandoned the special charter, which this city has operated under for years, for the popular commission plan. The second election under the Black law will take place tomorrow, at which candidates for commissioners and mayor will be placed In nomination. The court's ruling sweeps away all of the technical Btumbllng blocks raised by the antl-com-missionlats. The Black law was originally orig-inally attacked to hold It unconstitutional, but tho supreme court held It constitutional constitu-tional in every particular. The Second attack came through the Swain Injunction suit, disposed of in the court's opinion today. |
