Show Carnes to be sentenced Nov. 30 Charles (Chip) Carnes, Belen, N.M., appeared before Fourth District Judge David Sam Friday (Nov. 9) on a motion to have a presentence pre-sentence investigation. Judge Sam referred the matter to the Adult Parole and Probation Dept. for a pre-sentence investigation in-vestigation and report. Mr. Carnes is to appear Nov. 30 at 1:30 p.m. before Fourth District Judge Robert J. Bullock for sentencing. Mr. Carnes, one of four defendants in the July 24 slaying of Brenda Wright Lafferty, 24, and her daughter, Erica Lane Lafferty, 15-months, 15-months, in their American Fork home, had pleaded guilty earlier to two counts of conspiracy, to commit criminal homicide and one count of aggravated burglary. . Two counts of criminal homicide and a second count of aggravated burglary were dropped against him at that time when he decided to testify for the state. Mr. Carnes had waived his right to speedy sentencing at that time. Thomas R. Patton, attorney for Mr. Carnes, in requesting the pre-sentencing pre-sentencing report, told Judge Sam tJ-M at the time it was anticipated Ron and Dan Lafferty would have an Oct. 29 trial and he would testify at that time. With the trial delayed, Mr. Patton said, "We may never know; he may never testify." Kent Barry, deputy Utah County attorney told the court he had no objection to moving ahead with the sentencing of Mr. Carnes. Ricky Martin Knapp, a second suspect, was sentenced to the Utah State Prison for five years to life each on charges of second degree homicide and two counts of aggravated burglary by Judge Bullock Nov. 2. The sentences are to be served consecutively. Ron Lafferty, 42, and his brother, Dan Lafferty, 36, are still to be tried on two counts of criminal homicide, two counts of conspiracy to commit criminal homicide and two counts of aggravated burglary. Their trial was postponed in-definetly in-definetly when Judge Bullock ap pointed attorneys for the brothers. They had been declared competent to serve as their own attorneys by Judge Bullock just two days before the new motion. Ron Lafferty was commited to the Utah State Hospital for a 30-day evaluation to determine his competency com-petency to stand trial after he allegedly assaulted two jailers at the Utah County Jail. Michael Esplain and Gary Weight, court appointed attorneys for the Lafferty Brothers, filed a motion last week asking that Dan Lafferty also receive a 30-day evaluation. This motion had not been acted on Friday night. |
