Show Judge Ponders RDA Funds FreezeSuit The Board of Education's motion to escrow funds due to the Park City Redevelopment Redevelop-ment Agency from county taxes was heard Tuesday and taken under advisement by Third Circuit Judge Homer F. Wilkinson. The motion, brought by the board in its suit challenging the validity of the RDA. would, if granted, ; , prohibit the county from . ... disbursing to the RDA V - approximately $500,000 in taxes, representing that portion por-tion of personal property taxes which is assessed for education. The motion was made following a similar motion by the RDA to escrow payments it was making on Marsac School to the board. That motion was granted by the court and payments are now made to an escrow account, at Silver King State Bank. The payments represent approximately $160,000 every quarter, which the board indicates will begin affecting its current operating operat-ing budget in April. If the board's motion is granted by the court, the RDA stands to default on at least its Marsac obligation and possibly four other projects. , Please UirnJtQ page, ,7A v, More RDA Continued from Page 1 A "It could well mean the end of the RDA," said City Attorney Tom Clyde. "But I don't believe the court will do that," he added. The suit between the two entities was brought as a constitutional challenge to both the taxing ability of the RDA, and to its very existence. It followed close on the heels of the fire district's suit against the agency. The RDA withstood that suit, but the fire district commission filed its appeal on Dec. 20, 1982. Judge Wilkinson heard oral arguments Tuesday from board lawyer Bruce Finley and Park City Attorney Attor-ney Tom Clyde. In addition, said Clyde, the RDA filed extensive written points and authorities. The board filed nothing, according to Clyde.
