Show Planners React Favorably To Conditional Use Restrictions Planning Commissioners meeting last Wednesday evening reacted favorably to the Januarv1 17 Citv Council . decision to restrict the issuance of conditional use permits in residential zones ' V'.;-'. V:;:';"'.'' ' T:v' south of 12th Street. The, Council's action represented a compromise to an earlier recommendation from Commissioners Com-missioners calling for the restrictions to extend from 15th Street. On January 17. the condi- tional use permit restriction was enacted in the form of an ordinance. The ordinance was coupled with additional square footage, side-yard and setback requirements which were established criteria cri-teria for the Planning Commission Com-mission to consider when reviewing conditional use permit applications for property pro-perty north of 12th Street. Although projects south of 12th Street which were before the Planning Commission Commis-sion before December 6 were granted immunity from the conditional use permit moratorium, mora-torium, no such date was established by the City Council for the additional square footage, setback and side-yard requirements. After reviewing the recent action of the City Council, Planning Commissioners determined de-termined they would be more comfortable utilizing the setback and side-vard recom-mendations recom-mendations if they were included as part of the Land Management Code, rather than just implied criteria. Commissioners also determined de-termined that the goal of a 20 reduction in overall density in older residential areas was achieved by increasing setback and side-yard side-yard requirements and re-. re-. commended that the additional addi-tional square footage requirements re-quirements be deleted from the proposal. Planners would also like to vsee a cutoff cut-off date on the new requirements re-quirements similar to that included in the conditional use permit ordinance. In order to include the new requirements in the Land Management Code, a public hearing will be held February Febru-ary 21 as a prerequisite to , their adoption into law. The additional requirements essentially es-sentially increase minimum side-yard from 5 to 10 feet, and front yard setbacks from 15 to 20 feet. Also, any building fronting on two streets will have to apply front yard setbacks to rear ; .:. yards. Vfv Also to be addressed at the February 21 public hearing will be proposals to allow single family dwellings as permitted uses in estate zones and to establish boundaries for estate and residential development districts dis-tricts pertaining to 25 levels of slope. |
