Show to bo disappointed and somewhat ehagrJned over the situation that has arisen in connection with the pending cuprerae court appointments. The presidents consultations with tbe regular and insurgent Republicans Republic-ans and with the Democrats of the senate have developed a difference or opinion among the leaders of the Uiper house who promise ti make tbo president's already difficult task a much harder one. The president has consjlted senators In order to be sure that the nominations he makes will be acceptable to the continuing body. The "insurgent" senators, it Is said, are insisting that the new Judges shall tie men of sufficieutly alvanced ideas to decide questions of the day along broad lines and not te bound by mere iegal technicalities. The regular Republicans, on the other hand, are not willing that these new theories as to Judgeship qualifications shall bo the determining factor as to the fitness of candidates. Democratic senators have been insisting in-sisting that one of the new Justices shall be a Democrat.
