Formerly, however, a refractory refrac-tory Juryman was committed to prison pris-on and the verdict of the eleven was taken. In tho reign of King Edward III the judges decided that a verdict glvenby a majority was a nullity, nnd recommended that the Judges should carry the Jury about with them in n cart until they should agree. The old custom that jurors should fast untile un-tile they had agreed in their verdict prevailed long, but was mercifully relaxed somewhat In Tudor times, and during Queen Elizabeth's reign a banquet was usually piven to the Jury bv the successful party to a suit. |
