While operating on the floor of the local stock exchange, a deputy from the sheriff's office here, accompanied accom-panied by a San Francisco detective, approached Muir and served a warrant war-rant for his arrest on the charge of embezzlement preferred by Henry Greer of San Francisco, who alleges that Muir embezzled stocks valued at 90. The previous two charges on hlch extradition had been attempted were made by a man named Ault. Muir was taken before the governor gover-nor and an extended hearing given him. HJs attorneys argued that Greer had been paid part of his claim by a creditor firm in San Francisco, with whom Muir had arranged to handle his affairs under the special bankruptcy bankrupt-cy law of California, and intimated that Greer had been Induced to swear out the warrant by San Francisco police, po-lice, who were determined to have Muir returned to California, "by hook or crook." This, District Attorney Elliott, who pressed the requesx for .extradltion papers, denied. He abo argued that the assignment of debts on the part of Muir had no bearing on the case. Further hearing on the application was contlnuod until today. There Is now pending In the district dis-trict court an application for habeas corpus, made by Muir, following his arrest on previous warrants. Hearing Hear-ing on this writ is set for April 13. |
